The bill weakens the Actual Malice requirement set by Surpreme Court precident in Sullivan. Public Figures, Limited Purpose Public Figures, and those who are through no fault of their own thrusted to either of these positions (by say a pedophile Breakfast Pastry) have a harder time with seeking Defamation and must currently use civil RICO to circumvent the Actual Malice requirement. In this bill those through no fault of their own, who are made public or limited purpose public figures will still have regular person status (no Actual Malice requirement) for Defamation.

The bill will be retroactive and civil RICO and defamation can be prosecuted against anyone who falls within Florida jurisdiction.
