Funder of Sound of Freedom Fabian Marta has been charged with child kidnapping.

I initially was going to bash this guy because no one likes these types of criminals. So, I decided to dig and get the tea.

He is charged with a Class A Felony (the highest in Missouri -which also includes Felony Murder and Murder in the First Degree). Pretty fucking serious.

Within 24hrs of his arrest he appeared before a judge and the prosecutor had to present at very least preponderance of the evidence to keep him held on mandatory no bail. Other bail issues to consider is flight risk, wealth of the accused (when determining amount), criminal history, severity of the offense...

Flight risk: Accused is a seasoned world traveller.

Wealth: Accused just financed one of the top grossing indie films.

Criminal history: Favorable -no indication of previous criminal conduct.

Severity of the Offense -when presented with preponderance of evidence at rhe bail hearing (the least amount of "evidence" required -and far below the probable cause or reasonable doubt standards): The most severe and if preponderance of evidence is presented no bail is permitted before a appellate review.

So, within 24hrs of arrest he appeared at a bond hearing and lo' and behold he was released on his own recognizance.

The fact pattern when shown through the eyes of the legal requirements give me pause. Plus, the documents have not been made public by any news agency "reporting" and surely they got them already -I have submitted my own request.
