Here is why. First immunity for actions while in office ENDS upon conviction of impeachment. So, should a president engage in any conduct that is supposedly "illegal" the Congress will engage impeachment proceedings. If convicted in impeachment proceedings then the conduct no longer has immunity and criminal indictment can follow.
However, as is the case with President Trump, they did indeed impeach him on exactly the same charges alleged, then continued the impeachment when he was no longer President in office. He was NOT convicted in impeachment, and therefore he does not lose immunity.
The sole remedy to charge a President with ANY crime is impeachment first, then if convicted at impeachment a narrowly tailored indictment can follow (for only the acts that were impeached).
Impeachment cannot come post office. Though they tried and failed to do so with Trump the actual 2nd impeachment had been obtained while he was in office -leaving the question of proceedings to another day since the Supreme Court did not make the decision and Trump would thus didn't need to appeal. Impeachment cannot be done post office, and maybe the hearing can (or cannot, but it was with Trump -an open question of law that is irrelevent until the next time a president is impeached at the end of term and maybe has to have the hearing after transitio.
